The mystery plane was actually carrying Kentucky governor Ernie Fletcher. The transponder on the plane malfunctioned while in flight. As required, the pilot advised the FAA of this malfunction. The FAA never notified the military, almost causing the downing of a civilian aircraft, much less a civilian aircraft carrying a sitting governor.
Heads should roll.
